Title: NIP for 35 mph in 30 Zone!
Post by: Juliand on October 16, 2016, 10:10:17 pm
This is an update on my Speed Camera Trap post.... NIP received now. 35 mph in 30 zone. The APCO threshold is 35 mph. I am within the threshold - ie not over 35,  36 being the apparent trigger, unless I have mis-understood it.

Even my wife, who is a non driver says, surely they aren't doing you at 35mph. WTF. Any patronising comments about " anything over 30 is an offence" - get real - that's like a couple of millimeters on the speedo...... Maybe the 'Vicars and Bishops Forum' is more for you......

If I were to drive around with no number plates at all, the're aren't any Licence points associated with that and I could be blasting at 100+ mph....  only a fine.   I might as well have been doing 42 mph - it's in the same penalty band for the Hampshire Muppets of Law and Order. Very hacked off......

Just had the same in the works car ,difficult to argue we weren't over the limit I had a clean license for 28 years could go on about it being on a down hill stretch just as the speed dropped from 40 to 30 but don't think I'll risk it hoping /expecting to get a speed awareness course that will almost definitely make me a better driver  :driver:

Wouldn't argue unless I already had a few points

Shame that.  I was stopped doing 120 on the M6 last year  Officer was Very nice. He recorded my speed as 90 something mph which got me 3 points and £100 fine.  Not sure what 120 is in mm but its quite high I think

:happy2:did well there lucky not to get six points and if it was recorded over 100 you would be walking for a while

Ahem,35mph is more like 40mph if your going off the needle and not digital speedo

Section 9 has a table which covers your issue. Valid 2011-2015 , don' t think the guidelines have changed for this year.

Really feel for you with the 35 in a 30 buddy...seems unfair when you think about some of the appalling driving that's about, unseen and unactioned due to lack of traffic cars.

Speedo size.
I have a Road Angel Gem mounted on top of the dashboard, and find the digital speedo, right in my eyeline, a lot easier to use than the the car's dials. Works for me!

It seems harsh to me. As for the

am I missing something? My Golf is the other way around. When it reads 33/34mph on the needle the digital reads 30mph. Verified with those speed displays at the side of the road. :) Or are you implying that if he was caught at 35mph the speedo must have been reading 40mph?

Exact opposite. The visual speed i.e. needle must be less than the true speed of a car by EU regulations.

The speedo on the mk5 over reads i.e the actual speed is less than the indicated dial speed.

Yes! Another way of phrasing what I said.

It's not just on the mk5 though.

I was at a set of traffic lights in Hull around 3 years ago and 2 lanes went down to 1 after the lights. After jockeying for position with the car on the inside lane I "put my foot down" to get in front of him before the lanes merged. The camera van that was waiting after the lights recorded me at 32MPH and I got sent an NIP with the option of a speed awareness course!!!

No point arguing the case as the hole just becomes wider and deeper, so my advice would be to just swallow the bitter pill and laugh every time you don't get caught. ;-)

Oh and if you think I'm being holier than thou then I can assure you that you that I am far, far from being a saint.

It's not just on the mk5 though.

That is not what you said though, although might be what you meant.  What you said suggested that the needle on your cluster under-reads the true speed of the vehicle, whereas it actually over-indicates the true speed.  This is why the "10% + 2mph" guidelines are there.

The APCO threshold is 35 mph. I am within the threshold - ie not over 35,  36 being the apparent trigger, unless I have mis-understood it.
Threshold in this case means the speed at which you're charged. So If you were doing 34mph, you would have been okay. 35mph and above and they charge.

As others have pointed out, 35mph actual speed would have meant your speedo was reading close to 40mph.
