Just been stopped and given a ticket with this on it: CD10 - Driving without due care and attention
Not really going to defend myself as I was in the wrong, according to the letter of the law; mostly speed related.
Right, so, anyone had one of these?
Supposedly there's no real additional evidence supplied from the issuing officer just the code; and it goes " back " somewhere for review based on your driving history.
Driving History: Mature Driver, nearly 40, driving 20, Zero points on licence atm, although I have had a lot of points over the years on and off.
Anyone a Copper on here, that will know what the process is from this point? Is it generally a FPN 3 Points? Or more serious Summons? Or simply in the lap of the gods.
I'm sure it probably effects insurance more than a SP30 / SP50 etc... any experience?

I was. The back of the officers copy will gave further evidence on it. If it is ussued for careless driving then there is obviously more to it than just excess speed. Can't remember the name of the form you were given but think it may be a Traffic Offence Report. Generally the officer wants to make their life easier so issues the TOR for the easiest offence to prove and save a trip to court fir him or her. What happens next is different depending on several factors and the Police Service involved. I think a fixed penalty can be issued for careless driving nowadays. As far as insurance is concerned i am sure it will have a significant effect , perhaps 30% plus increase.
I would expect to get a summons , but the evidence offered is inknown so difficult to judge.

Hey :) Thanks for the response there mate. Yes more than speed but not a great deal, two lanes of traffic at a roundabout to National Speed Limit, both lanes ongoing straight ahead or turn to right for exit... car on right hand side indicating to turn off, I'm in lane one and under cut, someone merges into roundabout from left and cuts me up, so I overtake to avoid accident at speed - officer suggested if the guy who was exiting to the right (even with his signal on) had decided to go straight ahead there would have been an accident, hmm, how about the guy that just joined from the left cutting me and the under cover cop car behind, up!? ...Anyway.
So the evidence to support is on the officers copy or is it on mine too ( it's in the car atm, but can retrieve to support this post )
At the end of the day, I did speed somewhat thereafter to clear the obstruction and through frustration, to the depths of 5th hence why I'm not moaning; so this is what probably annoyed the copper more than anything.

Would have thought this would be a court appearance. If you had a FPN from him, that would state the number of points and level of fine.
This sounds more than a 3 points and £60 if it goes to prosecution. CD 10 could be up to 9 points and a hefty fine, dependent upon severity.
Do a bit of research. Annoying isn't it

Hiya, yes does look possible court appearance for something relatively vanilla - the CD10 ( through research ) can go from 3 to 9 points depending; minimum fines are now £100 a pop I've been led to believe.
He and his colleague were both very relaxed and not angry or chasing, seems quite unusal that this couldn't have been dealt with at the roadside which I did promote latterly in the conversation - which he returned by saying every incidence is now sent for an independent review rather than roadside... which I found quite bemusing, is this the truth?
Or was it indeed a way of him getting me " done " with little or no evidence of any speeding offense.

Driving without due care and attention carries a penalty of either a disqualification, or between 3 and 9 points. You can also be faced with a fine up to £2,500 depending on the nature of the incident.
The worse the driving, the worse the penalty will be. The following will always be seen as aggravating features;
Excessive speed
Carrying out tasks while driving
Carrying passengers or a heavy load
Tiredness
Causing injury
Causing damage to other vehicles or property
High level of pedestrians or other vehicles
Location, such as near a school

I got a cd10 years ago for speeding and causing a crash ooh and no insurance as the garage I worked for denied it was insured...The traffic copper was very good as I was looking at speeding 100mph in a 40 zone..no insurance and crashing the car
Got a.cd10 with 6 points £100 fine

Blimey Andy, you did well considering all the associated. Did you go to court? How was it, did you just plead guilty? Did your insurance noticably rise?
So many different sentences given out for motoring convictions, seems so strange, where someone on another forum was insured, no crash, zero points, but CD10 got 750£ fine and 6 points.

Sometimes I feel there's no order to these thing's and it's just what mood their in on the day, you may get lucky you may not. Hopefully nothing much comes of this. Good luck

I think you're over thinking it mate, or fearing the worst.
I'd be very surprised if throw the book at you for that \/ because let's face it, driving these days is a frickin nightmare compared to 15-20 years ago. A massive hike in traffic volume, along with a massive decline in driving standards to go with it.

That /\ kind of stuff I see on a daily basis, and far, far worse. I'm surprised I haven't been locked up with the way I drive sometimes, but 95% of the time it's just evasive driving to avoid the blithering idiots that clutter up my local roads......a sudden swerve here, a boot full of gas there.....it's got to be done if I don't want a blue rinser's Hyundai i10 stoved into the side of my car.
I just wish this country would get with the program. You can't slap everyone with the same blanket fine without taking the context into account. This bloody place is in the dark ages.

Agreed. Traffic offences are easy meat; easy to identify; easy to prosecute; easy to collect money. Driving standards and attitudes to other road users are pants. It's all 'me; me; me......,.I'm more important; more urgent; more right than anyone else............'

I got a cd10 and speeding August last year. Was 2am on my way home from work, as i joined the motorway from a slip there was a car in lane 2 doing like 60mph with no other vehicles in front of him for miles. So the time i joined from the slip we was side by side so i just carried on past him up lane 1. Then put my cc on at 85mph, bit futher up the road another car hogging lane 2 but this time i went into lane 3 to get past him. Then as i come back to lane 1 i see the blue lights behind me. Charged me with driving without due care and attention and speeding, im fully guilty of speeding but i was not driving without due care and attention. The only reason i under took was cause we was side by side as i joined the motorway and he also pointed out that i didnt undertake the other car further up the road. He must of had a bad day or just a full time prick.
I had to go to court, got 6 points and £490 fine for cd10 and 0 points and 0 fine for sp50

I'm going to remain confident but prepare myself for the worst... a hefty ( fairly undue ) fine and points like you @STV4R (http://www.mk5golfgti.co.uk/forum/index.php?action=profile;u=9131) :( my only saving grace really, is I currently have Zero points atm.
Not sure if anyone knows for sure, but in my neck of the woods these things tend to take a while according to the Police website; in the region of 15 weeks to " lay " papers to the court; does this seem about right? Or have I read that incorrectly?
I guess it really does depend now on a few things, those being how the JP feels on the day - how thickly the copper wants to push his explanation of events - and my driving history to date; which tbh isn't great, I've had a lot of speeding related fines over the years, but obviously at the moment a clean license... so perhaps shows some rehabilitation from previous convictions?

Your driving record will count against you when it comes to punishment. Your driving record will be within the paperwork but cannot be used till after conviction.

Really, that seems quite unfair, considering that those years have passed, I paid my fines, paid extra insurance costs... served my time so to speak yet they will be used against me years later.
If thats 100% correct which Im not suggesting it isnt, then Im fully screwed...
Ive had at least 20 points, all 3 point convictions but also a Section 59, in my driving years, not one rehabilation course and zero points at the moment.
Any guesses on points and fine Im going to receive?

...so even though according to the gov website my licence is completely clean and ALL points and issues have been automatically expunged over time served... these can be reincarnated to be used against me, to allow for higher fines and points during sentencing? Does anyone catergorically know?

Currently paying £16 per month with eSure, mods declared, Zero Points - 38 y/o driving 20 years
With CD10; estimated 6 points on a standard GTI5 cheapest is £36 per month over 55% increase at best.

Hahahhaha, so it is, lol... and thanks, it is a hell of an increase, however at this point £20 a month isn't my first worry, it's a stupidly ridiculous fine based on things that happened 5 / 10 / 15 years ago, which I find utterly unfair tbh; a manoeuvre to avoid an accident plus increased speed, can cost you a £1k+ fine plus 5 years of increased insurance at another £1.2k... bit of bollocks really.
Mind you, people get fined for moving through a red light to save someone's life ( out of the way of an ambulance )

Every case at court has a drivers previous driving history. It is only looked at if there is a guilty finding. As to whether it effects sentencing then only a magistrate can give you the answer. I was a Police Officer for 30 years and bad past record for any iffence imho effects the sentence.
