Title: Costco damaged my alloys.
Post by: gtlee on October 17, 2010, 11:06:01 pm
Last Monday went to Costco to get the fronts tyres that I bought 2 months ago when they were doing a 20% discount for 4 tyres. Arrived early it was empty good I thought so got served straight away so I went to get a bite and a hot drink.
I returned not long and watched them swap the tyres over in the waiting room,I noticed that they had trouble fitting one of the tyres but didn't take much notice and after half an hour it was ready.

It was driven out  by the fitter and being myself I had a good look at the alloys for any damage but it was covered in that white residual all over and it didn't seem to any damage so I headed home.

Today I gave the car a wash and to my disgust the wheel they were having greif with had marks all over the rim as if they had used a tyre lever bar and other scuff marks around the alloy,I know for one thing the alloys are totally unmarked before I went to Costco.

I rang Costco up straight away but no answer so I called the to speak to the general manager but his not about so the reception took my number and said will call me back.To my surprise the assistant manager rung and asked me to pop in so they can see the damage.

What chances of me getting them to pay for an new alloy wheel or anything at all?

They fooked 2 of mine up.

I had 4 tyres fitted by them in Reading, cleaned the car that night as the wheels were covered in sh*te, Superchips RR day and calledin on the way home. They said I should go and get quotes for 2 wheels and come back.

My mate does this for a living so he sent me a quote which I presented to them. They gave me some sh*te but eventually paid me out in cash on the day. Said they were going to mark my Costco card for proof that I had the work done but nothing.

Now I buy my tyres there but let anyone else fit them as they are fookin stupid. :fighting:

Hedge,

Thanks for the reply,I'm glad you got yours repaired but how did you prove it was them that f*ck up your alloys, need the ammo ready tommorrow so I can argue my case.
I noticed the damaged parts of the alloy wheel have identical width so maybe thats my evidence against them as the scuffs were caused by one object their F*uckin tyre lever.

I will update when I get it.

I had the exact same marks on 2 of my wheels caused by their tools.

To be honest they looked a bit bemused but I soon focused them.

Sorry to hear that. Local VW dealer did the same thing to me - thought it was odd that after a service incl. two new front tyres that they had washed the car except for the alloys, which still had that white stuff round the rim. At home I washed them to fing it scratched all round the alloy. They had to order a brand new alloy wheel  :surprised: This place should fix it for you.

UPDATE:

I went to Costco this morning and spoke to the guy who did my alloy damage,he came out to have alook whilst I maintained that they were faultless before tyre change.About 10 mins of huffing about he decided to get the supervisor who first of all was a right prat when he opened his gob.
I basically repeated to him what was said to the tyre fitter and said I'm not a happy bunny and want something done, the 1st guy started to make accusations that the scuff marks were my doing(lying out of his teeth probably trying save his job)that I kerbed it,this went on for awhile but no way was I backing down so he gets the manager who comes out and guess what after another 10 mins......I don't beleive my fitter did this cos the equipment won't allow them to work any other way.

By this time I was fuming and said sort it out or I will get evidence that it was tyre fitter at fault and will be back,he then responds by saying he will give me a ring back on Wednesday.

I'm not sure what outcome this will result in but heh I only went in for some new tyres and not for some damage to them.

Keep you guys posted.

There are scuff marks where the idiot used a tyre bar to lever the tyre on resting on the wheel rather than on the tyre machine,I pointed out the marks are of the same width as their tyre lever bar so rules out the question of kerbing.F*ckin w*nkers!!!!!!!!

do they have CCTV in their service area?

maybe u can ask to see that to prove they did use a lever instead of the machine?

what tyres did u have on the alloys btw before the change?

I wondered that about the cctv might have to ask the bastewards, I had Michelin pilot 2 and they had 20% off the pilot 3 thats what they were trying to fit.

In my case the marks were about an inch long on each wheel inside the rim protector.

Information like that can only help your case.

Thats what I noted btw I called costco up about if they had CCTV no luck they're not installed.

I had argued that the damaged was caused by a uniform piece of equipment the tyre lever, wednesday they said will give me an answer.

It would have been better if they had just said they can't do it!

Update:

Had a heated conversation with the assist. manager of costco and the result is a bad one,he believes his tyre fitters hadn't caused the damage to my alloy wheel and ain't gonna cough up.

He said he had watched the fitters at work and found methods were adhered to (right they would if you got someone eyeing your work)and no way it could be them.

So morale of the story is buy the tyres from costco when they have the 20% off offer and DON'T I repeat DON'T have your tyres fitted by them.

Any suggestions as to where to go from here.............at the moment I'm peeved off to say the least.

Sorry to hear that mate.
As you quite rightly point out buy the tyres when they are cheap and get them fitted elsewhere.  :sad1:

Letter to head office. Get the names of who fitted your tyres and the management you spoke to. Get the tool they used lined up against your wheel in the place that the marks are and take pics.

Hi-q damaged 3 of my 19" bbs rims during fitting of the tyres just a week after being freshly powdercoated.

They paid up for the refurb without any real arguments, your problem is that you drove away before reporting the problem.

Got any pics of the damage?

PDT  I had a look at the wheels before I left but there was so much of that tyre glue that I could not see any damage until I washed it.

The pics are in the earlier posts.

Or just try small claims, chances are they wont turn up and will rule in your favour. Make sure that you address it to the manager at their head office and not the local depot.

If you were local to me I know a man that can repair them but Costco should be doing the paying.

Actually, WRITE a letter to their Registered Office - this will be on the invoice.  Include a PHOTOCOPY of your invoice.  Sommat like this (copy and paste if you like ):

<COSTCO PLC - or whatever their legal company title is>
<Registered Office>

<TOWN>
<Post Code>

Dear Sirs

ADVANCED NOTICE OF LEGAL ACTION - BREACH OF CONTRACT

On <INSERT DATE>, I had four new tyres, <INSERT TYRE MAKE, SIZE, ETC> fitted to my car <INSERT YOUR TYPE OF VEHICLE & REG> at your <INSERT TOWN/CITY> branch.  On completion of the works, I duly paid the amount previously <AGREED OR ADVERTISED> in full by way of <CASH, CHEQUE, CREDIT CARD, etc>.

Upon the first opportunity I had to inspect the work <THAT BIT IS IMPORTANT>, I discovered the wheels were covered in some white substance which I presume is some lubricant to assist in mounting of the tyres.  I subsequently carefully cleaned off the white substance with a proprietory car shampoo, and discovered numerous areas of physical damage to my wheels.  This damage was NOT there before I bought my car to you for these new tyres.  I personally take great pride in the condition and appearance of my car, including regular cleaning and polishing of my alloy wheels.  Therefore, I have to conclude that the damage occured whilst my car was in possesion by your company to fit my new tyres, and this is a clear breach of the United Kingdom "Supply of Goods and Services Act".  Accordingly, I hold Costco wholly liable to the damage caused to the alloy wheels on my car.

I had subsequently returned to the branch, and attempted to discuss my concerns with the branch manager, explaining that the damage on my wheels clearly matched tyre levers and tyre change machine used at your branch.  Your branch manager attempted to accuse me that I had caused the damage by kerbing.  This accusation of me kerbing them is clearly withouth substance, as the damage does not match typical kerbing damage.  Your branch manager ultimately refused to accept responsibility, dispite having NO defence to my claim that the damage matches your tools and equipment.

Therefore, I am writing to the Costco Registered Office as a last opportunity for you to admit liability, and to co-operate fully in repairing the damage your company caused to my car.  I am seeking to have the damage on my alloy wheels caused by yourself to be restored back to the condition they were prior to you fitting the tyres - ie, in perfect, 'as new' condition.  This could mean the alloy wheels being sent away to a specialist alloy wheel repairer, and if that is not in any way sucessful, the purchase of new alloy wheels.

I expect a written reply within 7 days from receipt of this letter - with Costco admitting full liability for the damage, and with a concrete offer of the full cost of repair or replacement of my alloy wheels.  Should you fail to admit liability, or respond within 7 days, then your actions will force me to seek a County Court Judgement against your company in the Small Claims Court.  Should I need to take court action to recover what is lawfully owed to me, then Costco will also be liable to all additional costs relating to said recovery, including, but not exlusively, £15 per letter or other item of written correspondence, in addition to all postal charges.

Yours faithfully

You MUST send it by Recorded Delivery, AND First Class, and keep the receipt from the post office.  One or two working days after posting, log onto the Royal Mail website, and enter your Recorded Delivery serial number, check it has actually been delivered and signed for - do a screen dump, then print it.

Then wait 2 weeks before taking any further action - yes, I know you gave them 7 days, but it is accepted courtessy to give them an extra week (for sickness, holidays, etc).  I you get this far without any joy, come back for more help.

HTH

OH - someone else might want to double-check my grammar and spelling!

Hi,

I have just ran this by the wife (solicitor).  Good letter TT, but modify it slightly:

The expectation of a reply within 7 days is a little unreasonable, this being your first letter to Costco regarding the issue.  Change it to 14 days.

Also, you could should attach your photo evidence of the damage, the initial invoice, and details of the cost of repair/replacement.  This may prevent there being any delay whilst correspondence is exchanged between yourself and Costco.  (As you have already sent the evidence of damage )

Good luck,
Mark

The expectation of a reply within 7 days is a little unreasonable, this being your first letter to Costco regarding the issue.  Change it to 14 days.
Actually, if you re-read the thread - this letter is NOT the first contact.  The OP has already complained to the branch manager - so Costco are already 'on notice' of said dispute.  :P  So 7 days is perfectly reasonable.  But I also mentioned at the foot of my post to still allow 14 days as common courtesy.

Also, you could should attach your photo evidence of the damage, the initial invoice, and details of the cost of repair/replacement.  This may prevent there being any delay whilst correspondence is exchanged between yourself and Costco.  (As you have already sent the evidence of damage )
Costco branch manager has already been presented with the physical evidence - so whilst photos may be useful, there is no real need.  Also, with some photos, the damage may not acutally show up as good as in the flesh - so by sending photos - you may actually diminish your right of claim.

Keep as much evidence close to your chest - IF the quality of the evidence diminishes the fact.

TT, I said first letter, not contact.  7 days IS unreasonable, (from a solicitor), due to a staff being on leave, general office issues etc.  If he doent want to send the evidence straight away it will just delay the process, .......but that is up to him.

Anyhow, I said good letter to you ? and offered some more help to the lad via a good source.  Nowt wrong with that ! :P
