Well i decided to get an iphone off eBay as they was getting cheaper due to the iPhone 4S was coming out

i got the phone this morning via RMSPD, plugged it and updated to IOS5, did all the apps for my wife, set it all up,
then i went to test the phone call quality, it would not phone out or accept a call !!

i called T-Mobile (also my network provider) and gave them the IMEI,they then said the person who owned this phone
defaulted his account and its now with collections and the phone is Black listed, and they wont remove the Black listing without
him settling the bill,they also went on to say that they don't always black listed phones but because he had a £45 a month contract with a
Free handset the phone belong to them (he was effectively paying the phone off).

Firstly, i didn't think they could do this,i understand lost and stolen, but not defaulted on the bill

Secondly,i paid with my credit card through Paypal, will i have a good chance of getting my money back ???

call your credit card company and charge back.

as you've bought it off ebay through paypal open a case with the resolution centre. i reckon you'll get your money back one way or another.

As said,

Contact the resolution centre and your CC company. You will get your money back either way as the item is not sold as described.

i called the small post office it was posted from as it was sent from a rural area.
the lady remembered it, and said i dealt with that package,and good luck getting your money back
you bought the phone from a gypsy ! i then asked for the local police station number for that village.

but i don't think i have police grounds to go on.

If you used paypal that'll help you out. Paying with a credit card is a bonus as it'll give you protection as well. Have you contacted the seller?

If you paid through PayPal or credit card you'll be fine. Start a case with eBay and PayPal and it'll be sorted in no time.

How was the guys feedback btw?

Did you pay via PayPal? If so just open a case and you should be OK as they will freeze the funds in the sellers PayPal account. If he has withdrawn the money they will just put his account into a negative balance and recover the funds from him later. You'll probably win the case and your money will be returned. PayPal will then just chase him for the money.

If not, you also have the option of ringing your credit card company and requesting a chargeback. They'll want all the details and you should be able to get your money back that way.

Then buy my iPhone 4 off of me instead  :wink: lol

The advisor at T-mobile had sympathy for me and put me through to the loyalty team (knowing i was out of contract) and it was explained to the
loyalty team member who took over the call what had happened, and they did me an Iphone 4S White 32GB, £99 ,18 Month contract 35 a month.
which i was very happy with

i bought this one off eBay on the intentions to not upgrade and keep my cost down, but they did some phoning about and after talking to couple supervisors
they came up with that corking deal, now i just need to sit and wait it out for paypal

I asked the paypal advisor,After 10 days and they don't respond and you refund me, what do i do with this iphone, he replied, throw it away keep it
do what ya want with it??

If i have to send it to Paypal or the robbing Barstewards i will.
But if i don't have to, surely it can be sold on to the USA market,as there IMEI uk blocking isn't shared worldwide is it ?

Sometimes (depends on the company) they will pass it on to other markets.

Up to you really. If you get your dough back from PP or CC and they are happy you keep it then send it to mazuma as a broken phone and with the money you get treat the misses to a meal and a nice hotel for the night. Or buy a mod for the car :happy2:

I have absoloutely no idea why it says this, as we have had this phone for a year on t-mobile, and our contract has ended. it was given to us by my brothers business partner, who we know personally, and we are unsure as to why he has reported it lost or stolen. I dont know why it isnt working with you as it has the whole time with us, and we do have proof as purchase. If you like you can have his contact details. I have rang my brother to try to resolve the issue and he says that he wont be returning the money until the iphone is returned, as he doesnt wish to lose the money and the phone, please dont take this out on me because the phone isnt mine, im just the messenger.

how can they be out of contract on an iphone 4 thats has 1 months warranty left. T-mobile only do 18 month 24 month contracts and its a locked t-mobile as well

shall i just ignore all response now and let paypal sort it ?

i think you're obliged to reply. get written proof from T-Mobile of the status of the phone, then reply saying that you have written proof and then let Paypal and your credit card company sort it out.

We didn't get it back or just don't sign for it leave it at the sorting office and don't collect it

If paypal tell you to return the phone for a refund then make sure you use a courier the displays the signature online otherwise they won't be interetsed!

The person who sold you the phone took responsibility for the item by becoming the seller. Whether he is the 'messenger' or not - its his responsibility to sort the issue, not his brothers, or his brother business partner.

Communicate via the eBay messaging system only - that way there is an 'evidence' trail that PayPal can access of all communication.

Don't send anything back unless PayPal ask you to.
If you do end up sending it back send it via courier - like ParcelForce/City Link/Home/DPD etc - so you can track exactly where it is at all times. Services like Recorded, or Special Delivery, are not proper tracking since they only show a signature on delivery. If they refuse it etc at least with a proper courier you can see straight away whether its at a depot etc.

This is truly shocking. I wouldn't send it back ask Paypal what they advise ,the pikey twat will only sell it again to some other poor unsuspecting buyer .

PP or CC will get you your money back 99.9% sue off that ,

I noticed recently how hard Ebay have made it to leave negative feedback .

I feel for you I would be livid at least you should be covered please let us know how you get on

Do a positive feedback and leave a proper snotty post on it telling him how much of a scum bag he is, I know it will still come out has he has pos feedback but if someone is looking through it then at least they can see it,

yes but as far as i'm concerned the time he wasted getting it back he could have spent doing something else, like overtime work for example. ergo he's still lost out, and within his rights to leave rude feedback.
