Title: Parking Fine.....

Wondering if anyone can help me here, I have heard people say that private companies can't give u parking tickets and only the council can.

Well basically I was in Falkirk retail park and the carpark was mobbed! I was only popping in to the cinema to drop my girlfriends purse off to her so I parked in a disabled parking space for Litrally 5 minutes as there was about 20 free spaces at the front door. Came back to the cat 5 minutes later to find a ticket for a £60 fine!

Is there anyway I can get away without paying it??
Or do I just bite the bullet and pay?

If its a private company then dont pay, if its goverement, council, issued by either a council tivket warden ot traffic police and or regular and communal.support officers then.you have to pay.

I didn't know it was in fact illegal, I thought it was just common courtesy. It's not as if I was depriving someone of a parking space, there were around 20 empty disabled bays and I was only parked for a few minutes. I could see that point if there were only 1 or 2 spaces left then fair enough I wouldn't hav parked there.

What pisses me off is that disabled badge holders can park absolutely anywhere. They should be allowed to stop and pick up or drop off anywhere but not leave their car unattended anywhere regardless of safety - Blocking the view of a pedestrian crossing, for example. I think that some of them are disabled in the brain!  :stupid:  :rolleye:

And what pisses me off even more are those people who have a disabled relative and a blue badge but very rarely transport them and also park anywhere unsafely :fighting: [/rant]

As Robin says If you or your girlfriend aren't a blue badge holder then you should'nt use the bays - pay the fine for being lazy.

Robin I think you'll find there are quite strict rules on where you can or can't park with a Blue badge and Pedestrian crossings (zebra, pelican, toucan and puffin crossings), including areas marked by zig-zag lines aren't allowed.

Using someone else's badge for your own use isn't acceptable either; The badge is for there use and benefit only. It must only be displayed if you are travelling in the vehicle as a driver or passenger, or if someone is collecting you or dropping you off and needs to park at the place where you are being collected or dropped.
It also states, You must never give the badge to friends or family to allow them to park for free, even if they are visiting you. You should not allow non-disabled people to take advantage of the benefits from your badge while you sit in the car.

As per usual, the problem isn't with the rules, It's just that people choose to ignore them - just as we see all the time with people still using mobile phones :mad:

Falkirk retail park is often patrolled by a stout chap on bicycle with Hi-Vis vest, therefore the fine will have been enforced most likely by a private management firm. I'm not sure if there is a 'grace period' in disabled bays, but more often than not the disabled spaces outside the local Tesco store are abused by ATM users...and never any security chaps patrolling that area.

I have heard a lot of people that receive fines from private companies choose not to pay them and tend to get away with it?

Who has issued the parking ticket, TPS, UKPC etc.

I agree with RedRobin on this one. No blue badge = no right to occupy a disabled bay. Remember they are there for those with restricted mobilty.

With that said. If the ticket was issued by a private company it is not enforceable but expect a couple of letters demanding payment then threats of legal action.

Bin the fine, as above they will send you letters saying they are going to take action against you but the do nothing.

I racked up £420 in 3 days from the morrisons in Camden town, all 3 went in the bin

....Hopefully those fines weren't for parking in blue badge bays.

did i read correctly you thought able bodied people are obliged to park in delicated disabled bays if enough are free  :surprised:

Maybe Government ones these days do but they never used to bother, one of my mates GF's worked for greater Manchester council and she dealt with parking fines, apparantly they only had enough staff to deal with approx 25% of fines, so you had a 1 in 4 chance of having to pay, good odds  :happy2:

I'm a blue badge holder and there's a lot of places your not allowed to park on and even certain types of double yellow lines are not permitted for blue badge holders. Many people do abuse them as people have said above but what annoys me is I'm 24 and some people's eyes I look young, fit & healthy upon first looking at me and I have had various instances where I have had an argument in the middle of a parking area because people think I shouldn't be parked there. I can walk ok to a certain extent and have no visible injury but I have a prosthetic leg after an injury at work and I have to open my door fully so I can get my leg out of the car, in normal spaces this is very difficult and sometimes impossible. I agree you shouldn't have parked in the disabled bay but if you knew you was going to be 5 minutes and there was no regular spaces left but 20 disabled bays empty then I wouldn't have a problem as you have tried to find an empty regular space and I doubt 20 blue badge holders would suddenly turn up in that 5 mins.

I thought they have to wait 5 mins before being allowed to issue the ticket. So either he was watching you from the start or you had been a bit longer than you'd hoped for.

Saying all that though, I'd probably still try to refuse paying it as the fine probably won't go towards building another car park so more spaces could be made available which I think that's what should happen to parking fines

If its a private firm, ditch every warning letter, do not respond to any letters threatening court summons, they will give up trying to trace your address.

I had the same, photo of my car landed on the mat for parking and leaving parking area and leaving site to visit Toys R us next door. Bill went from £60 up to maximum £300 , then as time went on, ( months) different bailiff letters from different company's as each one had passed the case on as I'd not responded, the bill started getting cheaper to tempt me to respond lol.

They gave up after about 8 letters and now that was 2 years ago...

I don't have the Maserati yet RR, still trying to get the mrs persuaded but she won't change her mind until the S4 Cab & VXR8 get sold on. So that's what I'm doing haha

It is funny though when parking wardens come power walking over to me with a big fat grin on the face and then carry on walking past me when I stick the badge on the dash lol
