Can anyone advise me in this please?.
Bought the car 2 weeks ago and ramped it up found two X2 cv boots torn away from the retaining clips on outer sides don't know how to upload pictures here.
Dsg jerking and sounds abnormal as the one I test drove before this one didn't have any jerking and was quick with response when putting foot down.
This wasn't like that when I went to view it and test drove it but on collection is now more apparent and worrying me.
Can I demand my money back?
-
use photo bucket to up load pics.
The metal clips dig into the boot and split them as I had the issue
If you bought the car from a garage then take it back
-
Did you buy private or from a dealer. Whats the service history like - when was the last DSG service. Should be every 40k miles.
-
depends where you bought it from, if it was a private sale then would be 'sold as seen' and you'll be very lucky to get any money back. If it was a garage then you stand a far better chance of getting it fixed/ returning it.
-
Hello guys, bought the car from a private dealer in Milton Keynes and it has full history bar the last stamp on 66900 there abouts.
spoke to the seller and he's being a pri** and says call up the AA warranty.
he also mentioned it had an AA inspection which I fail to believe as these issues surely would have come up?.
found lots of hidden scratches on it covered by dirt which the guy said he would have polished out along with a full valet that was never done.
I really want a full refund and not a repair as this garage sell prestige crap :fighting:
Apparently the dsg was done at the last service but I'm having trouble believing this as the idiot doesn't send me the receipts he promised me. Also spoke to vw dealers and they cannot find any history of the dsg being serviced at all :surprised:
These boots look like they've been dying for years lol

Last service and dsg oil and filter service done below mileage but no proof sent as done by their independent garage and we know what that usually means (https://www.mk5golfgti.co.uk/forum/proxy.php?request=http%3A%2F%2Fi1374.photobucket.com%2Falbums%2Fag433%2FSandy1786%2FMobile%2520Uploads%2FScreenshot_2015-01-06-19-19-48.png&hash=0498bf70148849687c322b7c9c9a8cfc783059ff)

Not trying to sounds like a utter di*k to you but you clearly have not done a lot of research before you bought the car. I always do HPI check VOSA check call main dealer if it had stamps and also I would want receipt not only a stamp. As you can buy stamp of ebay what ever you wish for few quids. Also people will stamp book for near nothing. If he can't prove receipt then always means to me it didn't happen. It's either there or not. Dealers are notorious for hiding stuff that's how they make their money at end of day polish up a turd and sell for more. I found when I was looking for a car dealers was messing me around history didn't ad up services didn't ad up. Chances of you getting your refund I would say are slim to nothing unless you bought from a decent dealer. From what I am reading he is far from decent dealer. Sounds like you got yourself a bag of bolts with heap of trouble. Good luck hopefully it will not cost you to much to put it right am sure next time you will do a lot more research Into it. I have learnt the hard way by spending a good few thousands of pounds onto cars before I learnt to do a lot more research.
Sorry to hear that this potentially happened to you.

The law
When you buy a used vehicle from a trader you are making a legally binding contract. You have legal rights against the trader under the Sale of Goods Act 1979.
The vehicle should be:
- Of a satisfactory quality - free from minor defects, safe and durable for a reasonable length of time. When assessing satisfactory quality you should take into account the price you paid for the vehicle, its age, mileage and condition at the time of sale.
- Fit for its intended purpose or a purpose that you made known to the trader - fit to be driven on the road.
- As described - the vehicle should correspond with any description applied to it. In some circumstances, the trader may be liable for any statement made by the manufacturer of the vehicle.
If the vehicle is faulty , you are legally entitled to request one of the following remedies:
a full refund
compensation (damages)
repair or replacement
rescission or reduction in price
http://www.tradingstandards.gov.uk/cgi-bin/glos/con1item.cgi?file=*ADV0003-1011.txt
What i would do is send him a written letter recorded delivery expressing your dissatisfaction with the vehicle, what's wrong with it, what they've said and what you want.
If they still pie you off you'll need to send them another letter, a letter before action and threaten to take it to court.
Give citizens advice a call aswell, it won't cost you anything and they'll be able to give you better advice about the process than what I can.
if you want to see a letter before action I've got one I can send you that I've wrote.
I would say be careful aswell, was soon as you mention court they will speak to a solicitor, the reply that came from my garage was on an email that said without prejudice which meant it csnt be used in court and it was to try settle the dispute, can get complicated.
Keep us updated on here and we'll try help.
I had advice from a Jim on here, he works in the industry, his username is mateyguv
Good luck!

Cheers guys, I've spoken to consumer rights and they also mentioned a letter recorded delivered to the company in question and if they still fob me off then get back to them and get further advise also from the CAB.
Wouldn't mind this letter you have AndyBrown
These guys got sly and didn't have the car available for the second viewing or test drive and already had my £500 deposit so it wasn't as simple as walking away.
He told me he'd get the light scratch marks removed with polishing and that there was nothing wrong with the transmission but when I went to collect the car they moved it and I had to wait 3 hours for its return and should have realised something wasn't right :sad1: blastards made a fool of me and I just didn't see it at the time why they hid the car until it got dark and someone was washing it when I got back.
I know it'll be a pain but I have to get this money back as this car is not what I want with these issues and not looking for a repair job.
Thanks
-
Let us know how you get on mate..Goodluck
Hope you get it sorted ASAP
-
Make sure you put absolutely everything in the letters as you may need them in court.
Also just in case you haven't already, stop communicating via phone if you can, email them instead as again you may need that in court.
What's your email address I'll fire it over now.
-
I have a real bad feeling ill have to take them to court as the guys being a total :booty: with his attitude.
Definitely let you know either way and maybe I should name and shame these crooks.
-
Hopefully not he'll probably bottle it when he's threatened with taking it to court.
-
These are Asians bud, ASM Google um
The have in their showroom lamborghini Porsche maserati
M3 r32 etc
So cannot believe they'd rip off someone but I guess sheep in wolves clothing and very rude over the phone but I can't seem to record the conversations with my Samsung s5
-

Andy, did you sort yours out? :surprised:
-
Well... Kind of, after the letter he did agree to what I wanted.
Removed the Mechatronic and have it repaired, natures out the company said there was f*ck all wrong with it so now they think it's the clutch packs

Oh crap, feel for you mate, :(
I spoke to a vw dealer about the bubbled paint work and he said theyd honour a warranty but for the mechatronic unit as there is one stamp missing I'd have to pay full for the replacement. I asked him if they (vw) knew about these faults, the should be covered under goodwill and he replied only 3 years warranty from new and maybe if the customer had fully stamped book and always uses vw for their servicing needs ie loyal customer.
I'm going to be taking the golf off the road as consumer rights state if there's a fault, stop using it.
Lucky I've not sold my tt, as things are getting worse on the golf including engine shaking like when I first went to view it and was told throttle control valve was going to be replaced but now worse still. Tried using my vagcom on it but it didn't work, also tried vcds and still nothing.

This is the dodgy company

well its advertised with full history but you mention one is missing and also if the car came with a mot it shouldn'tpass with them cv boots
-
Awww man my worst fear :(
Hope you get this sorted bud. But what you do have on your side is that car was clearly mis advertised.

I can believe it, these garages want to spend the bare minimum in the hope the person buying the car doesn't spot the issues. You have to do your research and know your rights.
Hopefully you get this sorted.
-
'HAVING BEEN MAINTAINED REGARDLESS OF COST'...sounds it.
-
They sold a black 3dr Edition 30 DSG in the last month.
I've noticed it's now for sale at another trade seller.
Strange!
-
Dodgy traders mate, these cars are beaten about after the deposit has been paid which is why I told them I demand a refund and he came out with some cocktail and bull so now I have email evidence

Cheers Nino I'll put that in the letter too :happy2:

This has useful info. Some been said already, but if they are selling as a trader you have rights:
http://bit.ly/1Dbr5Cq
Those CV boots don't look like they should have passed any MOT.

Thanks flyingscotsman I've got a copy of that and will be sending the letter with this attached although I know the guy will be a prat about it.
-
Sorry to hear you are having issues.
May not be much help now but ask to see a copy of the AA inspection report? The dealer should have a copy if they had it checked?
I got the AA to check my car before I bought and the inspection report really helped. I even spoke to the inspector.
-
Hi and thanks Jamie,, he said they doesn't have them and the AA should send one in two weeks but lying again I bet.
I've not received any papers or even the receipts mot paper. :surprised:
If AA had inspected it would they have surely found these faults?
-
Jesus, I was going to travel and possibly purchase that car when I was looking at them as it looked and sounded pretty mint. Hope you get it sorted buddy! :ashamed:
-
FYI - That car would of 100% failed the MOT. Did that car have a new MOT for the sale? I would advise them that if they are not willing to help you then you are sure VOSA would love to hear that they sold a car with a new MOT that will clearly not pass VOSA standards. Im sure the dailymail would love to know too :)

I've been though this when I bought my audi tt and got 600 back for a faulty abs pump, the hid the abs light with tape :surprised:
Vosa doesn't do f all and only gives the MOT station a strike/points off and if those ointment build up then only will the company lose its licence for a while
thanks
-
thats sucks :(
-

Bless yah  :happy2:
I didn't want to get rid of the tt but will still have to go as I have no where for storage :sad1:
-
Received this as they are not wiling to give a full refund.
basically hey want me to go all the way back to their garage and waste my time when I don't have the time to do this.
I told their solicitor to get them to collect the car but they aren't interested.
Dear Sir
We refer to your letter dated 2 February.
Our letter of the 29 January was clear enough.
If you require our client to consider your claim the vehicle must be returned to it for inspection purposes.
Our client may offer repair, if appropriate.
It is a matter for you whether or not you choose to accept any such offer.
You will understand that it is not for us to advise you.
Once again, may we respectfully suggest that you contact our client soonest to arrange return of the vehicle for inspection purposes.
If you are not prepared to comply with such request then with regret there is nothing more that can be done to assist.
Should you have any doubt as to the nature and effect of this request then you may wish to seek independent legal advice.
We await your considered response.
Yours faithfully
-
I would say just take it there and see what happens your best option at the moment
-
This is a horrible situation to be in. I bought a Peugeot from a dealer up north (2 hours away) and had endless problems with it. Even had to have a new engine! You have to give them a chance to fix it even though all you want is your money back and drive the car through their showroom window! I frustratingly took the hit and part exchanged it in the end!
-
You do need to take it back to them. You don't need to accept their offer to fix it.
You should have your own list of fault with photos to back this up or alternatively pay for an independent inspection (eg AA).
The longer you delay then they may claim faults occurred after you bought it.

Can't trust them mate.

I'd love to but the law will have me lol thanks and sorry to learn of your misfortune :surprised:

Cheers mate, I'm just waiting of a final response and if not then dump the car there and take the small claims as I have waited too long for their replies and because of what the Citizens Advice told me to do.
-
Okay tried every avenue but these guys aren't willing to help so now I've got the claim form but looks like the prices for a small claims aren't so small (https://www.mk5golfgti.co.uk/forum/proxy.php?request=http%3A%2F%2Fi1374.photobucket.com%2Falbums%2Fag433%2FSandy1786%2FMobile%2520Uploads%2FScreenshot_2015-03-01-20-01-40.png&hash=cde291aa5ad5a0422773a0c65246e7901faf46c8)

It's worth doing tho if it's your last option.
Make sure you put the cost of the claim on there aswell.
Have you sent them a letter before action? When I done it I told the I'd be claiming for the court fees aswell as the cost of the car.

Hi Andy, yes I have told them that I'll be doing this as thier solicitor is saying I'd still have to get the car to them even when I said the car could break down on the way and he replied
I apologise for the delay in responding to your recent correspondence.
The practicalities of getting the car back to my client for inspection have proved somewhat challenging.
Nonetheless, I have asked my client to reconsider whether it can assist in this regard.
Whether you decide to issue proceedings or not it seems clear to me that the vehicle will need to go back for inspection in the first instance so the sooner that is done the better.
I hope to have some further news shortly
-
Are they stringing this out in the hope that you get fed up and drop the case etc? If they really wanted to help then they would have sorted out a flatbed etc to collect the car. I hope you get a refund as this car is shocking... Sounds also like a fake mot...

Hi kam, don't you mean £410 ? Bro
-
Once you win the case in small claims am sure it's about £100 to then move it to high court which then bailiffs will get involved
